Definition of Personal Information

Your “Personal Information” is information which identifies you, including your first and last name, address, e-mail address, telephone number, or any other information that permits you to be contacted physically or online. Essentially, it is the information which you submit to us when you set up an account to use ACKData Services. ACKData and ACKData Products and Services do not knowingly collect or store any Personal Information from anyone under the age of 18.

No Sale of Personal Information

The privacy and protection of your personal information is very important to us. Unlike Your DCD Data, which may be anonymously other otherwise analyzed by, used by, or sold to third parties in accordance with the DCD Data Policy and your DCD Data Permission Selection, your personal information will never be shared with or sold to third parties for any commercial or marketing purpose unrelated to the activation and delivery of ACKData Products and Services without your permission. We never rent or sell customer lists.

How Personal Information May be Used

Internal Uses: ACKData uses Personal Information to communicate with you, to provide, develop and improve ACKData Products and Services, or in an aggregated, anonymized form for research and marketing purposes. We may use service providers to perform some of these tasks, and such service providers will be restricted from sharing personal information for any other purpose. ACKData may also store your Personal Information to resolve disputes, enforce agreements, establish legal defenses, for internal business purposes, perform audits, and to comply with laws.

Multi-Party Provision of Services: We and our affiliates, service providers, vendors, and technicians who process and store information and otherwise support the ACKData Products and Services can access certain information about your account, but are not permitted to use Personal Information for any other purpose.

Sale of the Business: Upon the sale or transfer of the company and/or all or part of its assets, Personal Information may be part of the assets transferred or sold. In such event, ACKData will request the purchaser to treat all data under the privacy policies we had in effect at the time it was collected.

Legal or Safety Reasons: We may use, access, preserve, or disclose Personal Information in the event we have a good faith belief that same is reasonably necessary to: (i) meet any applicable law, regulation, legal process or enforceable government request; (ii) enforce ACKData policies or contracts, including investigation of potential violations; (iii) detect, prevent or otherwise address fraud, security or technical issues; (iv) protect against harm to the rights, property or safety of ACKData, our users or the public as required or permitted by law.

Third Party Collection: If your purchase, installation, or servicing of the ACKData Products and/or Services is performed by a third party, that third party may collect, store, and share your Personal Information subject to its own policies which are not subject to ACKData’s control. That third party mat collect Personal Information from you as part of that transaction, and may retain that Personal Information for their own purposes subject to their own privacy policies.

Deletion of Personal Information

ACKData will typically store your Personal Information on its servers until you delete it, and for as long as you remain a customer of ACKData Products and Services. You can delete your Personal Information from our servers through your account for ACKData Services.

Personal Information Security

ACKData uses industry standard physical, administrative, and technological methods to transmit and store Personal Information securely, and uses industry-standard methods to keep this information safe and secure while it is being transmitted. However, ACKData cannot guarantee that unauthorized third parties will never be able to defeat out security measures or use Personal Information for improper purposes. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those customers whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. We may process your Personal Information on servers that are not in your home country.

Please note that the terms of this Agreement may change from time to time. We will provide notice of any changes on your Account Portal or by contacting you.
